Is intercourse a way of reconciling?

 

The Short answer is Yes, any Islamic divorce process in Islam whether that be Khula / Faskh or Talaq the fact that these processes should only be deployed when all eventualities and possible actions have been exhausted.

Allah SWT makes reconciliation easy and Talaq / Khula / Faskh (Islamic Divorce) Difficult

That is the premise that Islam conducts itself when it approaches Islamic Divorce.

There are many Quranic Ayahs proving this statement and we encourage people to find the verses in the Quran and study these themselves.

These rulings also apply within during the period of Iddah, therefore any Islamic Divorce which has intimacy between the couple during the process of Talaq / Khula / Faskh is considered to nullify the process.

Our scholars have contemplated over the Quranic Ayahs and The Ahadith in the way which they were deployed by Nabi SAW and his Companions RA and we can unequivocally state that this ruling is more sound and in line with the practices of the Prophet Muhammad SAW.

This is also to discourage any people making emotional erratic decisions to apply for khula / faskh / talaq without going through the correct due diligence process as detailed in the manual of life, (The Noble Quran).

Intimacy (includes kissing and touching intimately) during / iddah / process of khula or faskh, the couple may live in the same house, but must sleep apart. The iddah gives the couple a chance to calm down and perhaps reconcile, as decisions are often made in haste.

Allah SWT offers every chance for the couple to make up and reconcile but we still keep insisting on speeding it up or making the rules work for us, often because we have been ill advised or have not studied the deen ourselves with any detail.

The rule of thumb is that Allah SWT with HIS infinite mercy makes reconciling easy and dissolving a nikah difficult and dissolving a nikah should only be exercised if you are absolutely certain there is no way of maintaining the relationship.

If a spouse forces themselves upon the other or uses a vulnerability against the other then that is abuse and the panel can decide to still dissolve the nikah in such cases as abusing or manipulation is haram (forbidden).
