Why we do not share reasons or allegations made by applicants

Assalaamu Alaikum Dear Brothers & Sister we are asked to share the allegations the applicant has made or reasons behind the Islamic Divorce application as the notice just says “The Applicant believes the Marriage is now beyond reconciliation”

The main reason for this is that Divorce can’t be a very traumatic task and is not very pleasant, we do wish for anyone to go through any more trauma than they have already been met with.

People then ask us if this is in line with the Islamic Traditions, yes of course it is in the Quran in 2 places that we can refer people to, firstly the couple are a “Libaas” covering for one another which literally means to cover each other’s faults and not to make them public, secondly Allah SWT orders for the Divorce to be handled in the kindest possible manner.

Unfortunately by the time the applicant comes to us, its usually already too late and all avenues have been exhausted, however if that is not the case and we do manage to convince BOTH parties to allow us to arrange or convene a meeting which is mutually agreed and respected then all reasons, allegations and solutions will be explored to try in every waty to save the marriage, if however this cannot be achieved or agreed then we ask people to remain calm and pleasant even if the decision is made against their wishes.

The Islamic contract (Nikah) is a 2 way agreement between BOTH parties, if either party chooses to walk away then the “OTHER” party should respect that and agree to disagree whether in their own eyes the decision is correct or not.

We also do not wish to start a chain of blame emails, (he said she said) or phone calls before both parties can agree to sit down and negotiate a way forward, trying to share allegations and accusations or even reasons sometimes before the right time can negatively impact people and outcomes and hence we need to be very careful before doing such things.

in April 2022 the UK Government has also  gone closer to the Quranic ruling on this issue and decided to have a new NO FAULT DIVORCE Policy
