Assalaamu Alaikum, Dear Brothers & Sisters we are often asked about the 3 different types of Islamic Divorces and we thought it would be best to highlight this as a blog on our website to direct people to in sh Allah.
The 3 types of Divorces that are available in Islam are as follows:
1. Talaq, which the man issues against his wife, you can go to the following link to learn more about how this type of Islamic Divorce is completed in accordance the Rules in Islam. https://www.theshariacouncil.org.uk/the-correct-process-of-talaq-in-islam
2. Khulla – This type of Islamic Divorce is applied for by the wife, if the MAN refuses to issue talaq and there is a complete process to fulfil in order for this to be applied and completed correctly, The complete process can be found here on the following link, https://www.theshariacouncil.org.uk/islamic-divorce-khulla-application/ if however anytime during this process the husband accepts the marriage has broken down and wishes to issue Talaq, the ISC will send the husband instructions on how to do this in the correct manner, this application will then be considered to be a talaq, not a khulla as the man has agreed to issue the Islamic Divorce.
3. Fasqh – This is actually most likely one of the most misunderstood types of Islamic Divorces by Muslims in todays society, this is actually a nullification of the Islamic Marriage and not a route to dissolve a marriage, in order to apply for a Fasqh the applicant and respondent need to confirm that the marriage was NOT consummated and the marriage is beyond reconciliation.
In all these cases, we do not try and investigate fault or blame to any party as we are not judges neither are we solicitors, we also believe strongly on the Islamic Principles that we should never look to wash our dirty linen in Public as the results are never fruitful in doing so.
